Linguistic Definition:
Al-Jinayat is the plural for jinayah, which is derived from jana/yajni, which
means to take something. The verb form is used in the following instance: Janaa At-thamara The fruit was taken [as from a tree]
Shariah Definition:
In the Shariah context, Al-Jinayat refers to any prohibited act that may cause
harm to one’s religion, soul, sanity (‘aql), honor, and wealth. The scholars have
divided the topic of Al-Jinayat into two categories:
1. The crimes resulting in prescribed punishments (Hudood)
2. The crimes punished by retribution (Al-qisas)
Our discussion will be restricted to the crimes punished by retribution.
